Terms of Service

These Terms of Service ("Terms") govern your use of petrovestscreen.com and the PetroVest Screen lease-screening service (together, the "Service"), provided by PetroVest LLC ("PetroVest," "we," "us"). By using the Service, you agree to these Terms. If you are using the Service for a company, you agree on its behalf.

1. What the Service is

PetroVest Screen screens oil and gas leases using production data from public sources, primarily the Railroad Commission of Texas, and ranks them against criteria you choose. It is a screening tool to help you decide which leases deserve a closer look.

2. Not investment, engineering, or legal advice

The Service's rankings, tiers, reports, and analytics are informational screening tools only. They are not investment advice, an engineering opinion, a reserves estimate, a valuation, or a recommendation to buy, sell, or operate any lease.

You are solely responsible for your own due diligence and decisions, including title, reserves, well condition, regulatory status, and price. Any decision to acquire, sell, or operate a lease is yours.

An engineer's review is offered only as a separate service under a separate written agreement. Nothing in the standard Service is an engineering review.

3. Data accuracy

The Service relies on public data that may contain errors, gaps, delays, or inconsistencies, and on screening methods that cannot account for every factor affecting a lease. We work to make the Service accurate, but we do not guarantee that any data, ranking, or report is complete, current, or error-free.

4. Accounts

You must provide accurate information and keep your login details secure. You are responsible for activity under your account. Tell us promptly at james@petrovestscreen.com if you believe your account has been used without permission.

5. Acceptable use

You agree not to:

  • copy, resell, sublicense, or redistribute the Service's rankings, reports, or data, except for internal use within your own business;
  • scrape, harvest, or bulk-download data from the Service;
  • reverse-engineer the Service or use it to build a competing product;
  • share your login with people outside your organization;
  • interfere with the Service's security or operation; or
  • use the Service for any unlawful purpose.

6. Fees and payment

Paid plans, trials, and pricing are as agreed at sign-up or in a separate order. Unless otherwise agreed, fees are billed in advance, are non-refundable, and renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. We may change prices with at least 30 days' notice before your next renewal.

7. Your content and our rights

Your content. Ratings, notes, criteria, and other information you enter ("Your Content") remain yours. We will not share Your Content with other customers.

Our use of Your Content. You allow us to use Your Content to provide the Service to you, and to use it in aggregated or de-identified form, so that it cannot reasonably be traced to you, to develop and improve the Service.

Feedback. If you give us suggestions or feedback, we may use them without obligation to you.

Our property. The Service, including its software, screening methods, rankings, and reports, belongs to PetroVest. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes during your subscription.

8. Text messages

If you give us your mobile number, you agree to receive text messages from PetroVest about your inquiry, scheduled calls, and your account. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, PETROVEST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PETROVEST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOSSES FROM ANY ACQUISITION, SALE, OR OPERATING DECISION, EVEN IF ADVISED OF THEIR POSSIBILITY.

PETROVEST'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

11. Indemnity

You agree to defend and indemnify PetroVest against claims arising from your misuse of the Service or your violation of these Terms.

12. Suspension and termination

We may suspend or end your access if you violate these Terms or fail to pay. You may stop using the Service at any time. Sections 2, 3, 7, and 9 through 13 survive termination.

13. Governing law

These Terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Harris County, Texas.

14. Changes

We may update these Terms. If we make material changes, we will notify active customers by email or in the Service before they take effect. Continued use after changes take effect means you accept them.
